Terms of Service

These Terms of Service ("Terms") govern the relationship between NN Popa Photography ("Photographer," "we," "us") and the client ("Client," "you") for all photography services rendered. By submitting a booking inquiry, signing a service agreement, or paying a retainer, you agree to these Terms.

1. Services

NN Popa Photography provides professional wedding, event, and portrait photography services in Kitchener-Waterloo, Hamilton-Burlington, Southern Ontario, and destinations worldwide. The specific scope of services — event date, coverage hours, deliverables, and pricing — is set out in the individual service agreement signed by both parties.

2. Booking and Retainer

A date is not reserved until a signed service agreement and a non-refundable retainer (deposit) have been received. The retainer amount is specified in the service agreement and is applied toward the total fee. We accept one booking per event date; the first client to complete both steps secures the date.

3. Payment

The remaining balance is due no later than 30 days before the event date unless otherwise specified in the service agreement. Late payment may result in cancellation of the booking. Accepted payment methods are set out in your service agreement. Prices are in Canadian dollars (CAD) and are inclusive of HST where applicable.

4. Cancellation and Rescheduling

  • Client cancellation: The retainer is non-refundable in all cases. If cancellation occurs within 60 days of the event, the full balance remains due. If cancellation occurs more than 60 days before the event, no further payment is required beyond the retainer.
  • Rescheduling: One rescheduling of up to 12 months from the original date is permitted at no charge, subject to availability. The retainer transfers to the new date.
  • Photographer cancellation: In the unlikely event that we must cancel due to emergency or illness, we will endeavour to provide a qualified substitute photographer. If a suitable substitute cannot be arranged, all fees paid will be refunded in full as our sole liability.

5. Copyright and Licensing

All photographs produced by NN Popa Photography remain the intellectual property of Narcis Popa / NN Popa Photography and are protected under the Copyright Act (Canada). Upon receipt of full payment, the Client is granted a non-exclusive, non-transferable personal-use licence to print, share, and display the delivered images for personal, non-commercial purposes. This licence does not permit resale, commercial use, or sublicensing without prior written consent.

We retain the right to use images for our portfolio, website, social media, and marketing purposes (see our Privacy Policy for opt-out options).

6. Delivery

Edited images are delivered via an online gallery link within the timeframe specified in the service agreement (typically 6–10 weeks for weddings). Rush delivery may be available for an additional fee. The online gallery is available for download for 12 months after delivery; we recommend downloading your images promptly. We are not responsible for images lost after the gallery expires.

7. Client Responsibilities

The Client agrees to:

  • Provide accurate event details (venue, schedule, key contacts) at least two weeks before the event.
  • Ensure the Photographer has reasonable access to all event spaces and subjects.
  • Obtain any venue or location photography permits required.
  • Inform us of any restrictions on photography (e.g., ceremony rules, no-flash requirements).

8. Limitation of Liability

In the event of equipment failure, unforeseen circumstances, or other factors beyond our reasonable control, our total liability is limited to the fees paid for the affected services. We are not liable for indirect, consequential, or special damages. We maintain professional liability insurance; details are available on request.

9. Force Majeure

Neither party is in breach of these Terms if performance is prevented by circumstances beyond reasonable control, including but not limited to natural disasters, government orders, or public health emergencies. In such cases the parties will work in good faith to reschedule or find a mutually acceptable resolution.

10. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of the Regional Municipality of Waterloo, Ontario.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be indicated by a revised "Last updated" date. Terms in effect at the time of signing your service agreement govern that booking.
